General Terms and Conditions (GTC) for Participation in the Bonus Points Program
1. Scope and Definitions
1.1 These General Terms and Conditions (hereinafter "GTC") of Premier Card Grading Germany GmbH (hereinafter "Provider") apply to participation in the Provider’s bonus points program by a consumer or business entity (hereinafter "Customer"). The inclusion of the Customer’s own terms and conditions is hereby expressly rejected, unless otherwise agreed.
1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or self-employed professional activity.
1.3 A business entity within the meaning of these GTC is a natural or legal person or a legally capable partnership that, when concluding a legal transaction, acts in the exercise of its commercial or self-employed professional activity.
2. Registration for the Bonus Points Program
2.1 Participation in the bonus points program does not require separate registration. However, the prerequisite is that the Customer creates a free customer account in the Provider’s online shop, in which the collected bonus points are stored. Upon successful creation of the customer account, the Customer automatically participates in the Provider’s bonus points program.
2.2 The Customer can create their customer account using the online form provided by the Provider. Submitting the registration data constitutes the Customer’s offer to enter into a user agreement, which the Provider may, but is not obliged to, accept. The Provider can accept the Customer’s offer within 48 hours of receipt by sending an electronic confirmation or by activating the customer account. If the Provider does not accept the offer within the aforementioned period, the offer is considered rejected.
2.3 The data requested during registration must be provided completely and correctly by the Customer. The Customer is obligated to keep this data up to date. The data provided will generally not be verified by the Provider for accuracy or completeness.
2.4 Each Customer may only create one customer account for themselves. The right to participate in the bonus points program is personal and non-transferable. This also applies to bonus points collected by the Customer.
3. Collecting Bonus Points
3.1 When ordering certain specially marked products via the Provider’s online shop, Customers will receive bonus points credited to their customer account. The crediting of points happens automatically after the order is shipped. Newly credited bonus points are subject to a 14-day holding period from the date the order is shipped.
3.2 Bonus points are only credited to the customer account through which the order was placed. Transferring bonus points to other customer accounts in the Provider’s online shop is not permitted.
3.3 Unless otherwise stated, the Customer will receive bonus points for each full euro of their net order value (gross order value minus taxes) as follows:
- Up to 100 €: 1 bonus point
- From €100: 2 bonus points
- From €200: 3 bonus points
Any additional shipping costs are excluded from this calculation. During special promotions, different bonus point values may apply and will be communicated to the Customer as part of the promotion.
3.4 If a contract is rescinded (e.g. due to revocation, termination, cancellation, withdrawal, etc.), no bonus points will be credited for that transaction. If bonus points have already been credited, they will be subsequently deducted from the customer’s account. The same applies in cases of incorrect point crediting by the Provider.
3.5 The Provider reserves the right to temporarily suspend or modify the bonus points program if other discounts or special offers are granted or if products are offered in the context of special campaigns or events.
4. Redeeming Bonus Points
4.1 Bonus points can only be redeemed in the Provider’s online shop for items specifically designated by the Provider at the specified point values.
4.2 Bonus points must be redeemed within 12 months of being credited to the customer account. After this period, the points expire.
4.3 Bonus points are redeemed on a first-earned, first-used basis.
4.4 Bonus points must be redeemed before completing an order. Retroactive redemption is not possible.
4.5 Bonus point balances cannot be paid out in cash or bear interest.
4.6 Bonus points are non-transferable and may only be redeemed by the owner of the corresponding customer account.
5. Storage of Bonus Points
5.1 The Customer’s bonus points are stored in their customer account and can be viewed at any time.
5.2 The Customer must raise any objections to the accuracy or completeness of the stored point balance within one month of becoming aware of it, in text form. If the Customer does not object within this time frame, the point balance is deemed accepted.
6. Termination of Customer Account
6.1 The user agreement (and therefore participation in the bonus points program) is concluded for an indefinite period and may be terminated by the Customer at any time without notice. The Provider may terminate the agreement with four weeks' notice.
6.2 The right to extraordinary termination for good cause remains unaffected. Good cause exists if continuation of the agreement until its regular end or until expiry of a notice period cannot reasonably be expected, considering all circumstances and interests.
6.3 Termination may be made in writing, in text form, or by the Customer deleting their customer account.
6.4 If the Customer terminates their account with immediate effect, all collected bonus points expire without compensation.
6.5 If the agreement is terminated by the Provider, the Customer will be given the opportunity to redeem their bonus points before termination, unless the termination was due to misconduct by the Customer.
7. Termination of the Bonus Points Program
7.1 The Provider reserves the right to discontinue the bonus points program with reasonable notice. In cases of good cause, discontinuation may occur without prior notice, taking the Customer's interests into account.
7.2 Upon discontinuation, the Customer may redeem collected points within four weeks from the date of announcement, in accordance with these GTC. Otherwise, the points will expire without compensation.
8. Right to Modify Terms
8.1 The Provider reserves the right to modify the content of the bonus points program and/or these GTC at any time, provided the Customer agrees.
8.2 The Provider may also modify the content of the program and/or these GTC without the Customer’s consent if:

required by a change in law;

complying with a court ruling or authority decision;

the change benefits the Customer; or
-
the change is purely technical or procedural and has no material effect on the Customer.
8.3 The Provider will inform the Customer of significant changes in a timely and appropriate manner. Significant changes are those that materially disadvantage the Customer or constitute a fundamental change to the agreement, such as rules on the type and scope of the bonus program or on duration and termination.
8.4 The Customer’s right to terminate remains unaffected.
9. Final Provisions
9.1 All legal relationships between the parties are governed by the laws of the Federal Republic of Germany. For consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country of their habitual residence.
9.2 If the Customer is a merchant, a legal entity under public law, or a special fund under public law based in Germany, the exclusive place of jurisdiction is the Provider’s registered office. If the Customer is based outside Germany, the Provider’s registered office is the exclusive place of jurisdiction if the agreement or claims arising from it are related to the Customer’s business or professional activity. In all such cases, the Provider is also entitled to bring action at the Customer’s place of business.
